Terms and Conditions of Group Training – JAVA Coffee Roasters

1. Information about the Service Provider

The owner and administrator of the online store javacoffee.pl, available at www.javacoffee.pl, is Java Coffee Company sp. z o.o. with its registered office in Warsaw, ul. Palisadowa 20/22, 01-940 Warsaw, entered into the register of entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000069052, NIP 5213214532, REGON 017395488, share capital: PLN 101,500.00 (hereinafter: the "Service Provider").

2. Subject Matter and Scope of the Terms and Conditions

  1. These terms and conditions (hereinafter: the "Terms and Conditions") set out the rules governing the provision by the Service Provider of training services under the names "Barista Basic," "Alternatives Basic," "Latte Art Basic," and "Home Barista" (hereinafter jointly referred to as the "Training"), offered via the online store javacoffee.pl, as well as the rights and obligations of the parties to the agreement concluded in this regard.
  2. The provisions of these Terms and Conditions apply to the trainings referred to above, offered in the Online Store as "Group Training." The current offer is available at Group Trainings – JAVA University.
  3. Before purchasing a Training, the Participant is required to read and accept these Terms and Conditions.
  4. The Service Provider enables these Terms and Conditions to be downloaded, saved, and printed.

3. Characteristics of the Training

The Training is an educational service provided in the form of group classes. The detailed scope and program of a given Training are set out in its description in the online store.

  • Number of participants: maximum 6 people;
  • Expected duration of the Training: 4 hours;
  • Each Participant receives a certificate of participation and a coffee gift.

3a. Training Language

The default language in which the Training is conducted is Polish.
Training in English is available by individual arrangement with the Service Provider, subject to advance notice of this need and confirmation of the trainer's availability.

3b. Training Program

The Training Program is available on the Service Provider's website alongside the description of the given Training and forms an integral part of the offer. The Service Provider reserves the right to introduce minor changes to the Training Program arising from organizational or substantive needs, provided that such changes do not affect the overall scope and purpose of the Training.

3c. Training Date

The Participant may select a specific training date from those available on the Organizer's website ("Fixed Date") or choose the "Open Date" option.

If Fixed Date is selected, the Training will take place on the chosen day and time.

If Open Date is selected, after purchasing the Training the Participant is asked to contact the trainer directly and independently select a meeting date from the group dates currently available, in accordance with the rules described in point 3d.

3d. Voucher Validity and Date Selection (Open Date)

  1. A Participant choosing the Open Date option has 12 months from the date the payment is credited to make use of the Training.
  2. After purchase, the Participant receives an email inviting them to contact the trainer to select a date. The Participant selects a date independently from the group dates currently published by the Organizer.
  3. If none of the currently available dates suit the Participant, the Organizer will inform the Participant of the expected timing of new dates.
  4. If, within 10 months of the purchase date, the Participant has not selected a training date, the Participant is entitled to a full refund of the Training cost, without having to state a reason and without having to wait for the 12-month validity period to expire.
  5. Once the Participant confirms a specific training date, the rules set out in points 5 and 5a apply.

4. Conclusion of the Agreement and Payment

  • The agreement for the provision of the training service is concluded by purchasing the Training via the online store javacoffee.pl.
  • A reservation of a place on the Training becomes binding once payment has been credited by the Service Provider. The number of places is limited, and participation in the Training is determined by the order in which submissions are made and paid for.

5. Change of Date and Cancellation of Participation

  • The Participant may cancel participation in the Training or request a change of date no later than 48 hours before the scheduled start of the Training. In such a case, the Participant may choose either a refund of the Training cost or to transfer participation to another available date.
  • If cancellation is submitted less than 48 hours before the start of the Training, no refund applies.
  • If the Participant is unable to attend and reports this fact less than 48 hours before the start of the Training, the Participant may transfer their place to another person of their choosing, at no additional cost.
  • The Service Provider reserves the right to change the Training date for reasons beyond its control, in particular due to the trainer's illness or other unforeseen events. In such a case, the Participant may choose to attend on another available date or receive a full refund of the amount paid for the Training.
  • If, as a result of a cancellation or date change by one of the Participants, the number of confirmed participants falls below the minimum set out in point 5a, the remaining Participants are entitled to transfer their participation to the nearest available date or receive a full refund, at their choice.

5a. Minimum Number of Participants

  • The Training will be held provided that at least 3 participants have registered.
  • The number of participants in a single group is limited to a maximum of 6 people.
  • If the minimum number of participants is not reached, the Service Provider may propose an alternative date for the Training to the Participant.
  • The new date is selected from among the proposals presented by the Service Provider and requires the Participant's acceptance.
  • If none of the proposed dates are accepted, the Participant is entitled to a full refund of the amount paid for the Training.

6. Right of Withdrawal from the Agreement

  • Where the Fixed Date variant is selected, the rules governing the right of withdrawal from a distance contract are set out in the applicable provisions of the Consumer Rights Act of 30 May 2014.
  • Where the Open Date variant is selected, a Participant who is a consumer has the right to withdraw from the distance contract within 14 days of its conclusion, in accordance with the rules set out in the Consumer Rights Act.

7. Protection of Personal Data

The Participant's personal data provided in connection with the purchase and completion of the Training is processed by the Service Provider in accordance with applicable personal data protection regulations and the Privacy Policy available on the Service Provider's website.

8. Final Provisions

  • In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law apply, in particular the Civil Code and the Consumer Rights Act.
  • These Terms and Conditions enter into force on the date of their publication on the Service Provider's website.
