Promotion Terms and Conditions – "Discount Code – TEA10"
§1. Organizer
The organizer of the Promotion is Java Coffee Company Ltd. with its registered office in Warsaw, at Palisadowa 20/22 Street (01-940 Warsaw), entered into the register of entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under number 0000069052, with NIP: 5213214532, REGON: 01739548, and share capital of 101,500.00 PLN ("Organizer"), e-mail: info@javacoffee.pl, phone number [_].
The Promotion is organized in the Organizer's Online Store available at: javacoffee.pl.
The User is obliged to read the Terms and Conditions before starting to use the Promotion. The Store provides the ability to download, save, and print the Terms and Conditions.
§2. Definitions
Terms written with a capital letter should be understood as follows:
- Order Form – a form available on the Online Store’s website allowing for the placement of an Order;
- Civil Code – the law of April 23, 1964, as amended;
- Discount Code – the discount code "TEA10" that entitles the user to a discount as per these Terms and Conditions;
- Consumer – an adult natural person with full legal capacity, making a purchase from the Seller not directly related to their business or professional activity;
- Client/Participant – a natural person with full legal capacity, and in cases provided for by universally binding laws, a person with limited legal capacity, who intends to or is participating in the Promotion;
- Terms and Conditions – these Terms and Conditions of the Promotion;
- Discount – a 10% discount on Products available in the Online Store granted based on the "TEA10" discount code;
- Organizer – Java Coffee Company Ltd. based in Warsaw;
- Promotion – the Promotion for Clients organized by the Organizer in accordance with these Terms and Conditions;
- Goods/Product – a movable item or service available in the Online Store’s offer;
- Validity Date – the time during which the Discount Code can be used on the website www.javacoffee.pl/en;
- Online Store – the Seller’s online store available at www.javacoffee.pl/en;
- Subscription – a method of ordering Goods that allows the Client to receive a specified type of Goods monthly;
- Sales Agreement – the agreement for the sale of Goods within the meaning of the Civil Code.
§3. Conditions of Participation in the Promotion
- Only a Client who is a consumer may participate in the Promotion. Participation in the Promotion is completely voluntary.
- The Client can join the Promotion by adding Products eligible for the "TEA10" discount code to the cart and entering the discount code in the appropriate field during the completion of the Order Form.
- The Client participating in the Promotion is obliged to provide data that is accurate. The Client is prohibited from using the Promotion in a manner contrary to its purpose, these Terms and Conditions, or the law.
§4. Conditions of the Promotion
- The Discount Code may be communicated via the Online Store, notifications, e-mail, SMS, leaflet, or coupon.
- The discount code may be used by Clients with an account in the Online Store, as well as by non-registered users or users without an account.
- The discount of 10% upon applying the Discount Code is calculated from the gross prices listed in the Online Store.
- The Discount Code entitles the user to purchase products with the Discount from the offer presented in the Online Store.
- The Promotion includes the Goods listed in the "Tea" section of the online store. The Promotion does not include test sets.
- The value of the discount is distributed proportionally to all products in the cart.
§5. Conditions for Opting Out of the Promotion
- The Client may, at any time and without giving a reason, opt out of using the Discount Code, especially by removing the previously entered code or by discontinuing the placement of the Order.
§6. Complaints Procedure
- Complaints related to the Promotion may be submitted by the Client in writing to the following address: Palisadowa 20/22 Street (01-940 Warsaw), or via email to: info@javacoffee.pl.
- It is recommended that the complaint includes as much information and circumstances concerning the subject of the complaint as possible, in particular, the type and date of the irregularity and contact details – this will facilitate and expedite the processing of the complaint by the Organizer.
- The Organizer shall respond to the complaint without undue delay, no later than within 14 days from the date the complaint was submitted.
§7. Final Provisions
- The condition for using the Promotion is to read and accept the content of these Terms and Conditions. By joining the Promotion, the Participant is deemed to have accepted the Terms and Conditions.
- In matters not regulated by the Terms and Conditions, the universally applicable provisions of Polish law shall apply. If mandatory provisions of law regulate the rights of the Client or obligations of the Organizer in a manner different from these Terms and Conditions, such provisions shall apply instead.
- These Terms and Conditions are available on the website www.javacoffee.com.
- The Organizer will process the Client's personal data in accordance with the Privacy Policy.
- The Organizer reserves the right to amend the Terms and Conditions for an important reason, which is:
- A change in existing or introduction of new universally binding legal provisions that directly affect the content of the Terms and Conditions;
- The issuance of an administrative decision or court ruling that necessitates a change in the Terms and Conditions;
- Correction of obvious typographical errors;
- The necessity to adapt technical and IT solutions in the organization of the Promotion to market conditions related to technical and IT advancements.
- The introduced changes to the Terms and Conditions shall not affect the rights acquired by the Participants. The changes to the Terms and Conditions will be published with a 2-day notice. Participants who do not accept the provisions of the new Terms and Conditions may opt out of the Promotion.
- In matters not regulated in these Terms and Conditions, the provisions of Polish law shall apply, in particular, the Civil Code, the Consumer Rights Act of May 30, 2014, the Personal Data Protection Act of May 10, 2018, the Act of July 18, 2002, on the Provision of Electronic Services, and other applicable universally binding legal regulations.
- The choice of Polish law under these Terms and Conditions does not deprive the Consumer of protection granted to them under the law, which cannot be excluded by agreement, that would apply in the absence of this choice of Polish law.
- These Terms and Conditions shall come into force on October 21, 2024.
- In matters not regulated by the Terms and Conditions, universally applicable provisions of Polish law shall apply.
